<p>WASHINGTON - Government officials handling billions of dollars in oil royalties partied, had sex with and accepted golf and ski outings from employees of energy companies they were dealing with, federal investigators said Wednesday. ADVERTISEMENT</p>
<p>The alleged transgressions involve 13 former and current Interior Department employees in Denver and Washington. Their alleged improprieties include rigging contracts, working part-time as private oil consultants, and having sexual relationships with — and accepting golf and ski trips and dinners from — oil company employees, according to three reports released Wednesday by the Interior Department&#8217;s inspector general.</p>
<p>The investigations reveal a &#8220;culture of substance abuse and promiscuity&#8221; by a small group of individuals &#8220;wholly lacking in acceptance of or adherence to government ethical standards,&#8221; wrote Inspector General Earl E. Devaney, whose office spent more than two years and $5.3 million on the investigation.</p>
<p>&#8220;Sexual relationships with prohibited sources cannot, by definition, be arms-length,&#8221; Devaney said.</p>
<p>The reports describe a fraternity house atmosphere inside the Denver Minerals Management Service office responsible for marketing oil and natural gas that energy companies barter to the government in lieu of cash royalty payments for drilling on federal lands. The government received $4.3 billion in such royalty-in-kind payments last year. The oil and gas is then resold to energy companies or put in the nation&#8217;s emergency stockpile.</p>
<p>&#8220;During the course of our investigation, we learned that some RIK employees frequently consumed alcohol at industry functions, had used cocaine and marijuana, and had sexual relationships with oil and gas company representatives,&#8221; the report said. Two government employees who had to spend the night after a daytime industry function because they were too intoxicated to drive home were commonly referred to by energy traders as the &#8220;MMS Chicks.&#8221;</p>
<p>Between 2002 and 2006, nearly a third of the 55-person staff in the Denver office received gifts and gratuities from oil and gas companies, including Chevron Corp., Shell, Hess Corp. and Denver-based Gary-Williams Energy Corp., the investigators found. Two oil marketers received gifts and gratuities on at least 135 occasions. One admitted having a one-night-stand with a Shell employee. That same individual allegedly passed out business cards for her sex toy business at work, bragging that her income from that business exceeded her salary at the Interior Department.</p>
<p>Devaney said the investigations took so long because Chevron refused to cooperate. An Interior Department official said Chevron would not allow investigators to interview its employees.</p>
<p>Don Campbell, a Chevron spokesman, said Wednesday that the company &#8220;produced all of the documents that the government requested months ago.&#8221; A Shell spokeswoman said it would be premature for the company to comment on the report until it had time to review it.</p>
<p>The reports also said former head of the Denver royalty-in-kind office, Gregory W. Smith, used cocaine and had sex with subordinates. The report said Smith also steered government contracts to a consulting business that paid him $30,000 for his work from April 2002 through June 2003. Smith retired from the office in May 2007.</p>
<p>Smith&#8217;s attorney, Steve Peters, called the claims &#8220;sheer fantasy.&#8221;</p>
<p>&#8220;Greg Smith was a loyal, dedicated employee of the federal government for more than 28 years,&#8221; Peters said Wednesday. &#8220;His efforts in running the royalty-in-kind program resulted in one of the most profitable government programs in American history.&#8221;</p>
<p>MMS Director Randall Luthi, in an interview, said the agency was taking the report &#8220;extremely seriously&#8221; and would review the allegations and weigh taking appropriate action in coming months. The inspector general is recommending that current employees implicated be fired and be barred for life from working within the royalty program.</p>
<p>House Natural Resources Chairman Nick Rahall, D-W.Va., said &#8220;this whole IG report reads like a script from a television miniseries and one that cannot air during family viewing time. It is no wonder that the office was doing such a lousy job of overseeing the RIK program; clearly the employees had &#8216;other&#8217; priorities in that office.&#8221;</p>
<p>One of the employees named in the investigation, Jimmy Mayberry, already has pleaded guilty in U.S. District Court in Washington to violations of conflict-of-interest laws. The Justice Department declined to prosecute Smith and former Associate Director of the Minerals Revenue Management program Lucy Querques Denett, who the report says manipulated contracts to ensure they were awarded to former Interior employees.</p>
<p>The findings are the latest sign of trouble at the Minerals Management Service, which already has been accused of mismanaging the collection of fees from oil companies and writing faulty contracts for drilling on government land and offshore. The charges also come as Congress and both presidential candidates are debating whether to open up more federal offshore waters to oil and natural gas drilling.</p>
<p>&#8220;This all shows the oil industry holds shocking sway over the administration and even key federal employees,&#8221; said Sen. Bill Nelson, D-Fla. &#8220;This is why we must not allow Big Oil&#8217;s agenda to be jammed through Congress.&#8221;</p>
<p>Rep. Darrell Issa, R-Calif., urged Democrats to reopen a House investigation of the Minerals Management Service that was initiated in 2006 by House Republicans. &#8220;Looking into and fixing these problems would have meant highlighting the enormous revenues that domestic oil and natural gas production contributes to our treasury. This just didn&#8217;t fit into their anti-drilling campaign,&#8221; he said.</p>
<p>While most government royalties for drilling on federal lands are paid in cash, the government in recent years has been receiving a greater share of its oil and gas royalties in the actual product. More of that oil is also being sold on the open market, versus being deposited in the Strategic Petroleum Reserve, the nation&#8217;s emergency oil stockpile. Congress earlier this year passed a law halting deposits of oil to the reserve to help alleviate high gasoline prices.</p>
<p>The investigation was prompted by a 2006 phone call from an employee in the Denver office who reported ethical lapses.</p>

<p>&#8220;There&#8217;s nobody smarter in politics,&#8221; Obama said on CBS&#8217; &#8220;Late Show with David Letterman,&#8221; scheduled to air Wednesday night. &#8220;And he is going to be campaigning for us over the next eight weeks, which I&#8217;m thrilled by.&#8221;</p>
<p>The two were scheduled to have lunch Thursday at Clinton&#8217;s office in New York. Clinton spokesman Matt McKenna said the former president would campaign for Obama at a yet-to-be announced site in Florida on Sept. 29, with plans for more fundraising and events in the works.</p>
<p>Sen. Hillary Rodham Clinton already has been hitting the trail for Obama.</p>
<p>During the Democratic presidential primary, the former president acted as his wife&#8217;s chief defender from Obama&#8217;s successful challenge to her candidacy, which strained relations between him and Obama. Clinton portrayed Obama as too inexperienced for a presidential run, and Obama said sometimes it was hard to tell which Clinton he was running against.</p>
<p>The two didn&#8217;t speak for nearly a month after the campaign ended, but their silence ended when Obama called and the former president offered to do whatever he could to help Obama win.</p>
<p>Obama said there are parallels between his campaign against Republican John McCain and Clinton&#8217;s 1992 race against incumbent GOP President George H.W. Bush. He said both came during tough economic times.</p>
<p>&#8220;He was young and people were still trying to figure out whether or not the guy was up to the job,&#8221; Obama said of Clinton. &#8220;And so I think having him talk about why we need to change the economy in a fundamental way so it works for middle-class families so that they can get ahead, so that they can send their kids to college, I think he&#8217;d be a great advocate to have on behalf of the campaign.&#8221;</p>
<p>Letterman asked Obama if he would consider Bill Clinton for a Cabinet position if he wins.</p>
<p>&#8220;I think if you are a former president, you don&#8217;t take Cabinet positions,&#8221; Obama said to laughter from the audience. &#8220;I think it&#8217;s sort of been there, done that. It&#8217;s sort of like getting Mickey Mantle to play AAA. You don&#8217;t do it. But obviously you consult with him as often as you can, because, look, there are only a handful of people who have actually done the job.&#8221;</p>

CNBC&#8217;s Darren Rovell reports on his blog that the former Mr. Johnson would be forced to buy out the stock of the 100,000 remaining &#8220;C. Johnson&#8221; jerseys before making the switch to &#8220;Ocho Cinco&#8221;. If Reebok asked Ocho Cinco to pay for the cost of making the unsold jerseys, the total could reach upwards of $4 million (or $50 million pesos).</p>
<p>Because Johnson changed his name so close to the start of the season, Reebok was left in a bind since they&#8217;d have to produce new jerseys and eat the old ones. That&#8217;s why the NFL has told Johnson he&#8217;d have to reimburse the company for the price of the jerseys. That&#8217;s not unprecedented, rookie linebacker Keith Rivers did it last week when he changed his uniform number. Of course, Rivers didn&#8217;t have thousands of jerseys with his name on it on sales racks nationwide.</p>
<p>This whole charade, of course, is pretty ridiculous. It&#8217;s tough to defend Johnson, as he&#8217;s so narcissistic that he makes T.O. look like Mother Teresa. And the NFL is so blatant in their attempts to block Johnson from donning his new name on the back of his Bengals jersey that it almost seems beneath them. Sure, it&#8217;s inane and self-serving and could set a bad precedent, but shouldn&#8217;t the league be focusing on more important issues, like stopping players from celebrating touchdowns?</p>

The first step is nationalization. Eventually they should sell them off as 10 different private companies with no more ties to the U.S. government. This is going to cost the Treasury A LOT of money, but is necessary to get them out of the mortgage market. Fannie was necessary in 1938 but not in 2008. It is going to strain the Treasuries&#8217; finances. It can also mean much higher Treasury interest rates, offsetting any narrowing of mortgage spreads. <p>We congratulate Treasury Secretary Hank Paulson for finally  acting on the advice of many in the market, including <em>The IRA</em>, and imposing a conservatorship on Fannie Mae (NYSE:<a title="More opinion and analysis of FNM" href="http://seekingalpha.com/symbol/fnm">FNM</a>) and Freddie Mac (NYSE:<a title="More opinion and analysis of FRE" href="http://seekingalpha.com/symbol/fre">FRE</a>). Moving a week after Labor Day is not bad timing at all and now enables us to focus on the next task, namely providing the financial resources to backstop the FDIC (see our earlier comment, &#8221;<a href="http://us1.institutionalriskanalytics.com/pub/IRAstory.asp?tag=301">Memo to the President-Elect; How Much Capital Does a Bank Need?&#8217;,  August 21, 2008</a>&#8220;).</p>
<p>Call Paulson&#8217;s announcement a good but still half step in the  right direction. Thoughts:</p>
<p>The Treasury has sought to reassure the debt markets, but has done so in a way that tries to maintain the fiction of private ownership of FNM and FRE. In so doing, Secretary Paulson only draws greater and greater attention to the contradictions and strains inside both GSEs. Indeed, the statement from OFHEO explicitly draws attention to the conflicted business models of both FNM and FRE:</p>
<p>&#8220;The Boards of both companies consented yesterday to the conservatorship. I appreciate the cooperation we have received from the boards and the management of both Enterprises. These individuals did not create the inherent conflict and flawed business model embedded in the Enterprises&#8217; structure.&#8221;</p>
<p>We understand from news reports that the boards of directors of both GSEs have told OFHEO and the Treasury that they will only take down $1 billion in new preferred, this because neither entity has an immediate cash need and the boards are reluctant to dilute existing holders of both the common and preferred. But this situation only illustrates the half-way nature of the Treasury plan and the untenable position facing FRE and FNM directors.</p>
<p>Under delaware law, corporate directors have a duty of care to the corporation they serve - not to shareholders. Why each and every director of FNM and FRE with any common sense does not resign immediately is a wonder to us.  OFHEO may not blame the directors of FNM and FRE for the &#8220;inherent conflict and flawed business model embedded in the Enterprises&#8217; structure,&#8221; but civil plaintiffs certainly will.</p>
<p>Once the Treasury and OFHEO announced the conservatorship, the control of the two federally charted corporations clearly was taken away from the public shareholders and the corporate directors.  With the government making wholesale changes in management and apparently taking operational control of both enterprises, how can any director of FRE or FNM be comfortable continuing to serve?  We can&#8217;t wait to see the 8-K that is eventually filed with the SEC by FNM and FRE explaining the Treasury takeover. The public disclosure of both companies is becoming more surreal with each passing day.  Again, given the relevant provisions of Sarbanes-Oxley, how can any director of FRE and FNM be comfortable continuing to serve?</p>
<p>Going back to the platypus metaphor that we and others have applied to the GSEs, the fact that these government sponsored entities are still traded on the NYSE and are subject to SEC registration has and will continue to complicate life greatly.  As we understand the Treasury proposal, Paulson will use general public funds to purchase preferred debt in the GSEs that carry a 10% dividend as well as warrants.  The Treasury&#8217;s strategy is apparently intended to provide a buffer between the GSE common and preferred shares (which presumably will be left worthless if the Treasury purchases the full $100 billion authorized, but not officially wiped out) and the unsecured, corporate debt of both GSEs, which is used to fund the retained portfolios of both enterprises.</p>
<p>Of course, were the common and preferred equity of the GSEs to be exhausted, losses would then fall upon the unsecured debt holders - thus the Treasury approach makes a certain amount of sense in terms of protecting all bond holders and holding out the hope - slim as it may be - that the Treasury can <em>eventually</em> sell its controlling stake in the GSEs for a profit.  That&#8217;s apparently why the Treasury has told the NYSE that FRE and FNM will continue to trade, but we hope that the NYSE eventually summons the courage to delist both firms.  The new concerns about accounting irregularities alone should give the NYSE pause in allowing these heavily damaged issuers to remain listed.</p>
<p>Thankfully, OFHEO and Treasury seems to have embraced our view that the retained portfolios must be reduced over time to just $250 billion for both GSEs combined. This is about the right size to support the conduit operations in the secondary markets but leave the portfolios so small that they no longer constitute a systemic risk.  However, we continue to believe that an outright nationalization is the most rational path for Washington to pursue, probably after the November election is decided. Once losses at the GSEs reach a certain level, buying more and more preferred shares is going to become an increasingly futile and painful exercise as common and preferred shareholders of the GSEs are slowly consumed.  Then the Congress will be forced to act to re-nationalize both GSEs and put the public holders out of our misery.</p>
<p>The &#8220;inherent conflict and flawed business model&#8221; referred to by OFHEO is gradually making the US the laughing stock of the industrialized world. But since the source of the conflict within the GSEs ultimately stems from political corruption in Washington, corruption which is embedded within national housing policy and which the Big Media refuses to acknowledge much less pursue, fixing the problem may take an even deeper and more serious financial crisis than the one now generally expected.</p>
<p>But all things considered,  Secretary Paulson&#8217;s actions deserve our support.  We put out the following  statement on Saturday:</p>
<blockquote><p>Reports of the impending takeover of the GSEs by the Treasury and the creation of a conservatorship to [manage] the $6 trillion in direct and indirect commitments made by these two entities is great news for the markets and the taxpayer. Contrary to some news reports, the conservatorship should not result in a large immediate need to raise cash for either entity. Indeed, the sharp decrease in borrowing costs that will likely occur next week will provide immediate and continuing relief to both Fannie and Freddie. While the GSEs may require some public subsidy in the medium term to help meet guarantee commitments, particularly if loan loss rates in the US continue to mount above levels seen in the early 1990s, the good news is that a scaled down GSE operation that sheds the retained portfolios, prices guarantees realistically and focuses on the historic role of secondary market maker for US mortgage lenders actually will generate stable profits for taxpayers. If the GSEs are run like a utility, and not a hedge fund, then they can be a stable and entirely unremarkable part of the financial scene. The impending conservatorship is hopefully a way to make the former business model a reality.</p></blockquote>
<p>Now that the Treasury at least partly has followed our recommendation and taken the GSEs off the table as a concern for the bond investors who hold trillions of dollars worth of GSE debt, the markets and the respective presidential candidates can focus on the next, more pressing challenge, namely helping to refloat the US banking system. Our indicators for lender stress in the US banking industry as of Q2 2008 are already above early 1990s levels, thus the timely action on the GSEs by the Treasury allows Washington, regardless of who wins in November, to now focus on how to put in place the resources necessary to triage unsound banks and help sound institutions begin to make loans and securitize these assets for investors.</p>
<p>Hopefully Paulson and his peers in the US regulatory community are already working on this next, much larger piece of the puzzle.  Again, we believe that by Election Day the Congress needs to have authorized up to $500 billion in new borrowing authority for the FDIC and the creation of an &#8220;RTC II&#8221; vehicle to carry and sell failed banks and assets.  Only when we fix the commercial banks and enable them again to make new loans into the primary market for credit will the secondary market role of the GSEs again become relevant to a reviving US economy.</p>

			<content:encoded><![CDATA[<blockquote><p>Prior to the announcement I was worried that [the Treasury] would maintain the status quo and continue to throw money at [the GSEs]… Now it appears they are fundamentally changing them, which is good. These companies are now in the process of going away. They even threw in the FHLB (via a secured lending facility) which is also a positive step as they need to go too. The first step is nationalization. Eventually they should sell them off as 10 different private companies with no more ties to the U.S. government. This is going to cost the Treasury A LOT of money, but is necessary to get them out of the mortgage market. Fannie was necessary in 1938 but not in 2008. It is going to strain the Treasuries&#8217; finances. It can also mean much higher Treasury interest rates, offsetting any narrowing of mortgage spreads. (Jim Bianco, Bianco Research, September 8, 2008)</p></blockquote>
<p>We congratulate Treasury Secretary Hank Paulson for finally  acting on the advice of many in the market, including <em>The IRA</em>, and imposing a conservatorship on Fannie Mae (NYSE:<a title="More opinion and analysis of FNM" href="http://seekingalpha.com/symbol/fnm">FNM</a>) and Freddie Mac (NYSE:<a title="More opinion and analysis of FRE" href="http://seekingalpha.com/symbol/fre">FRE</a>). Moving a week after Labor Day is not bad timing at all and now enables us to focus on the next task, namely providing the financial resources to backstop the FDIC (see our earlier comment, &#8221; Paulson</p>
<p>Call Paulson&#8217;s announcement a good but still half step in the  right direction. Thoughts:</p>
<p>The Treasury has sought to reassure the debt markets, but has done so in a way that tries to maintain the fiction of private ownership of FNM and FRE. In so doing, Secretary Paulson only draws greater and greater attention to the contradictions and strains inside both GSEs. Indeed, the statement from OFHEO explicitly draws attention to the conflicted business models of both FNM and FRE:</p>
<p>&#8220;The Boards of both companies consented yesterday to the conservatorship. I appreciate the cooperation we have received from the boards and the management of both Enterprises. These individuals did not create the inherent conflict and flawed business model embedded in the Enterprises&#8217; structure.&#8221;</p>
<p>We understand from news reports that the boards of directors of both GSEs have told OFHEO and the Treasury that they will only take down $1 billion in new preferred, this because neither entity has an immediate cash need and the boards are reluctant to dilute existing holders of both the common and preferred. But this situation only illustrates the half-way nature of the Treasury plan and the untenable position facing FRE and FNM directors.</p>
<p>Under delaware law, corporate directors have a duty of care to the corporation they serve - not to shareholders. Why each and every director of FNM and FRE with any common sense does not resign immediately is a wonder to us.  OFHEO may not blame the directors of FNM and FRE for the &#8220;inherent conflict and flawed business model embedded in the Enterprises&#8217; structure,&#8221; but civil plaintiffs certainly will.</p>
<p>Once the Treasury and OFHEO announced the conservatorship, the control of the two federally charted corporations clearly was taken away from the public shareholders and the corporate directors.  With the government making wholesale changes in management and apparently taking operational control of both enterprises, how can any director of FRE or FNM be comfortable continuing to serve?  We can&#8217;t wait to see the 8-K that is eventually filed with the SEC by FNM and FRE explaining the Treasury takeover. The public disclosure of both companies is becoming more surreal with each passing day.  Again, given the relevant provisions of Sarbanes-Oxley, how can any director of FRE and FNM be comfortable continuing to serve?</p>
<p>Going back to the platypus metaphor that we and others have applied to the GSEs, the fact that these government sponsored entities are still traded on the NYSE and are subject to SEC registration has and will continue to complicate life greatly.  As we understand the Treasury proposal, Paulson will use general public funds to purchase preferred debt in the GSEs that carry a 10% dividend as well as warrants.  The Treasury&#8217;s strategy is apparently intended to provide a buffer between the GSE common and preferred shares (which presumably will be left worthless if the Treasury purchases the full $100 billion authorized, but not officially wiped out) and the unsecured, corporate debt of both GSEs, which is used to fund the retained portfolios of both enterprises.</p>
<p>Of course, were the common and preferred equity of the GSEs to be exhausted, losses would then fall upon the unsecured debt holders - thus the Treasury approach makes a certain amount of sense in terms of protecting all bond holders and holding out the hope - slim as it may be - that the Treasury can <em>eventually</em> sell its controlling stake in the GSEs for a profit.  That&#8217;s apparently why the Treasury has told the NYSE that FRE and FNM will continue to trade, but we hope that the NYSE eventually summons the courage to delist both firms.  The new concerns about accounting irregularities alone should give the NYSE pause in allowing these heavily damaged issuers to remain listed.</p>
<p>Thankfully, OFHEO and Treasury seems to have embraced our view that the retained portfolios must be reduced over time to just $250 billion for both GSEs combined. This is about the right size to support the conduit operations in the secondary markets but leave the portfolios so small that they no longer constitute a systemic risk.  However, we continue to believe that an outright nationalization is the most rational path for Washington to pursue, probably after the November election is decided. Once losses at the GSEs reach a certain level, buying more and more preferred shares is going to become an increasingly futile and painful exercise as common and preferred shareholders of the GSEs are slowly consumed.  Then the Congress will be forced to act to re-nationalize both GSEs and put the public holders out of our misery.</p>
<p>The &#8220;inherent conflict and flawed business model&#8221; referred to by OFHEO is gradually making the US the laughing stock of the industrialized world. But since the source of the conflict within the GSEs ultimately stems from political corruption in Washington, corruption which is embedded within national housing policy and which the Big Media refuses to acknowledge much less pursue, fixing the problem may take an even deeper and more serious financial crisis than the one now generally expected.</p>
<p>But all things considered,  Secretary Paulson&#8217;s actions deserve our support.  We put out the following  statement on Saturday: Bernanke</p>
<blockquote><p>Reports of the impending takeover of the GSEs by the Treasury and the creation of a conservatorship to [manage] the $6 trillion in direct and indirect commitments made by these two entities is great news for the markets and the taxpayer. Contrary to some news reports, the conservatorship should not result in a large immediate need to raise cash for either entity. Indeed, the sharp decrease in borrowing costs that will likely occur next week will provide immediate and continuing relief to both Fannie and Freddie. While the GSEs may require some public subsidy in the medium term to help meet guarantee commitments, particularly if loan loss rates in the US continue to mount above levels seen in the early 1990s, the good news is that a scaled down GSE operation that sheds the retained portfolios, prices guarantees realistically and focuses on the historic role of secondary market maker for US mortgage lenders actually will generate stable profits for taxpayers. If the GSEs are run like a utility, and not a hedge fund, then they can be a stable and entirely unremarkable part of the financial scene. The impending conservatorship is hopefully a way to make the former business model a reality.</p></blockquote>
<p>Now that the Treasury at least partly has followed our recommendation and taken the GSEs off the table as a concern for the bond investors who hold trillions of dollars worth of GSE debt, the markets and the respective presidential candidates can focus on the next, more pressing challenge, namely helping to refloat the US banking system. Our indicators for lender stress in the US banking industry as of Q2 2008 are already above early 1990s levels, thus the timely action on the GSEs by the Treasury allows Washington, regardless of who wins in November, to now focus on how to put in place the resources necessary to triage unsound banks and help sound institutions begin to make loans and securitize these assets for investors.</p>
<p>Hopefully Paulson and his peers in the US regulatory community are already working on this next, much larger piece of the puzzle.  Again, we believe that by Election Day the Congress needs to have authorized up to $500 billion in new borrowing authority for the FDIC and the creation of an &#8220;RTC II&#8221; vehicle to carry and sell failed banks and assets.  Only when we fix the commercial banks and enable them again to make new loans into the primary market for credit will the secondary market role of the GSEs again become relevant to a reviving US economy.</p>

<p>Now you know what the rules of logo design are, you can distinguish the difference between a good and a bad logo… By knowing what other logos have succeeded <em>and why</em> they have succeeded gives a great insight into what makes a good logo.</p>

<p>After you have got your design process sorted out, it is usually a good time to begin mastering your software. But before I get to that, I just want to point out that Step 4 and Step 5 overlap - as it is a catch 22 situation… You can’t design a logo by just hopping straight onto the computer nor can you design a logo without knowing your software (such as Adobe Illustrator).</p>
<p>Anyway, putting this aside, after you have got your initial ideas and sketches from brainstorming you can then usually jump onto the computer to start digitizing your logo. After you have got a great concept(s) digitized you can send it to your client, get revisions, and eventually complete the logo and thus, you have successfully created a professional logo.</p>

<p style="text-align: justify;">It is interesting (to within an order of magnitude; when you’re at work; alolita.com and it’s a slow Facebook day) to consider the professional response to Labour’s 10p blunder. Suggestions on <a href="http://www.accountingweb.co.uk/cgi-bin/item.cgi?id=183118&amp;d=1032&amp;h=1019&amp;f=1026&amp;dateformat=%25o%20%25B%20%25Y">this forum</a> ranged from “restoring the 10p band and cutting benefits” to the solution eventually adopted.</p>
<p style="text-align: justify;">Professional opinion is pretty much universal that the whole move was daft, a disgrace etc. In particular, there is a healthy scorn for the notion which <em>Darling, darling!</em> has successful palmed off on laypeople (ooh, you weirdos), that losing the 10p rate is somehow a giant leap forward in “simplification”. Any adviser will tell you that a single, immobile universal tax band on income with no exceptions or optional extras ranks as one of the simplest tax measures imaginable (then they’ll charge you £550+VAT).</p>
<p style="text-align: justify;">Particularly galling to me was <em>Darling, darling!</em>’s repeated weaselly insistence that one “cannot just unpick” a Budget when it is precisely as unpickable as any other bill on its Third Reading (which I concede may not be very unpickable at all; the point is there’s nothing special about tax legislation). Again, he’s relying on lay unfamiliarity here. The bit of legislation that says the personal allowance shall be £x, the starting rate shall be 10p, the basic rate shall be 22p, the higher rate shall be 40p etc etc says… well, pretty much that. And every month thousands and thousands of payroll agents up and down the country go into their payroll software and implement what the legislation says.</p>
<p style="text-align: justify;">Pay As You Earn tax is a system which is, on the whole, foolproof and immune to abuse. There’s really nothing mystical about changing the rates, nor is there anything profoundly simplifying in doing so. It’s the work of five minutes and one crazed junior treasury minister with a blank piece of Statutory Instrument headed notepaper and a pen, and after that they never have to think about it again.</p>

It’s the reliefs, the exceptions, the oddballs, the (nasty word approaching) <em>loopholes</em>, most commonly found in capital gains tax, corporation tax and inheritance tax and rarely sighted anywhere near your common or garden PAYE income tax, that make up the complications.</p>
<p style="text-align: justify;">However, it was clearly in <em>Darling, darling!</em>’s interest to suggest that the whole process was vastly more complicated than it actually is, because that bought him time to negotiate the borrowing of the £2.7bn. What he really meant by claiming that it’s difficult to unpick a budget is that he can’t just palm off the cost on another group of taxpayers after the main budget debate has been and gone; he alolita.com has to get more funding from outside instead. Good to know that Labour still shrinks from that much open tyranny.</p>
<p style="text-align: justify;">In fact, alolita.com never mind the complication, it’s still in his interest to pretend the whole thing was just a ghastly mistake (it was a Big Fat Lie; there is no way it could have been anything else; a junior tax assistant could have spotted the problem, given the figures on earnings and tax credit take-up). He’s not just blinking with terror like a rabbit in the glare of The Great Jon Snow because he’s had to make a U-turn. He’s blinking because he’s still trying to hide just how disgraceful the whole thing is. We’re treating this as the crisis point for Labour over the 10p tax affair when in fact this is the home straight. They’ve nearly got away with a shocking piece of straightforward deception.</p>

<p style="text-align: justify;">Sadly for the British people (not a phrase I care to use very often because it makes me queasy, as if I’ve eaten a big lardy slice of Tory Pie) the official opposition are in cahoots with <em>Darling, darling!</em> on this. It’s in Gorgeous Georgina Osbourne’s interest to make the whole thing sound far more complicated than it is as well, because he doesn’t understand a single bloody word of it.</p>
<p style="text-align: justify;">This is why he keeps uttering mystical pronouncements such as ”The cupboard is bare” and “They didn’t mend the roof when the sun was shining” like some exceptionally mundane sybil. I’m listening out for when he starts saying “They didn’t tie the giraffe up in time and now the hamster’s mother has outgrown the chocolate undergarments” because then we’ll know he’s getting overconfident.</p>
<p style="text-align: justify;">And of course, even if Gorgeous Georgina wasn’t the dunce of the Tory front bench, the Tories still need to maintain the illusion of complexity because they don’t want to commit themselves to any spending plans. One of the easiest ways to avoid this is to pretend that taxing and spending is a great alternative universe of Mystic Numbers Whose Wot We Cannot Possibly Know Until You Have Voted Us Back Into Power <em>Where We Deserve To Be AHAHAHAHAHAHA!!!!! ahem, ahem, sorry</em>, and that it would be totally impossible to, say, assemble the basic toolkit alolita.com of a calculator and the back of an envelope and start jotting some possibilities down.</p>
<p style="text-align: justify;">This is politically clever because everyone believes them - I’ve even heard this touted as a Tory strength. I’ve heard it seriously suggested that they can’t do anything until they’ve “got in and seen exactly what kind of mess everything is in”, as if the economy is run out of a bunch of A5 cashbooks that Gordon Brown keeps locked in his kitchen drawer rather than a national system open to constant public scrutiny. So, politically clever, but economically and democratically grossly irresponsible, and underlines their sheer unashamed power lust.</p>

I am indebted to <a href="http://millenniumelephant.blogspot.com/">Daddy Richard </a>for the knowledge that GG receives, every week, a Treasury Briefing. This briefing would enable him, at the whirl of a spreadsheet, to build a whole new quantified tax package, and know where every pound of revenue was coming from, and in what proportion. Tomorrow.</p>
<p style="text-align: justify;">It wouldn’t tell him about outcomes of course; all the precautionary impact studies would remain to be taken. But the groundwork is there any time he cares to pluck it out of the air. Maybe he’s been guiltily stuffing his weekly Treasury Briefing down the back of the sofa for the last few years. Come to think of it, isn’t his little patch of the Tory front bench looking a bit… <em>bulky?</em></p>
<p style="text-align: justify;"><strong>The solution</strong></p>
<p style="text-align: justify;">Bad news if you’ve been mollified by <em>Darling, darling!</em>’s <a href="http://news.bbc.co.uk/1/hi/uk_politics/7397705.stm">announcement</a>, because here’s the dirty little truth: he’s pulled the same trick on you again. Essentially, Gordon Brown’s great miscalculation in his last budget as Chancellor, which may yet be the undoing of him in his first election as Prime Minister, was to think that middle earners would be so chuffed with their 2p basic rate cut that they would ignore the fact that it was stripped off the backs of the low earners.</p>
<p style="text-align: justify;">Well, rather than spending his extra borrowing on, say, reinstating the 10p band, <em>Darling, darling!</em> has now spent £2.7bn on a rise in the personal allowance which <em>still</em> leaves earners of between £6,000 and £12,500 worse off if they’re not on tax credits and also has the rather neat effect of benefitting those middle income net gainers from the Budget <em>still further</em>. £120 further, as he didn’t tire of saying on R4 this morning.</p>
<p style="text-align: justify;">I’m not saying raising the personal allowance isn’t a totally admirable goal, but his emphasis on helping middle income hardworking families facing rising fuel and food bills blah-blah-please-love-me is so strong that it’s perfectly obvious that helping NMW workers isn’t the main agenda.</p>
<p style="text-align: justify;">As the <a href="http://www.litrg.org.uk/">Low Incomes Tax Reform Group </a>unhappily puts it,</p>

By all means reduce taxes on low earners, and generally encourage people into work at entry level. But so long as there is a burden of taxation, everyone should bear some of it. That is the moral principle.There is also the practical fact that those on low incomes are more likely to be in receipt of state education, social housing, health care and what have you, so their natural tendency is towards statism. If they are outside the tax system, this will only get even worse.</p>

I don’t accept there is a moral principle in getting everyone to pay tax. Low income earners, objectively speaking, got very little out of their state-funded education. The high income earner, by contrast, does very well out of the system and thus should surely be the one making the greater contribution.Anyway, even if personal allowance was raised to £50,000, everyone would still be paying tax, plenty of it, in the form of VAT and excise duties.</p>
<p>Ultimately all income taxes are a deadweight cost on the economy, but income taxes on low wages are particularly pernicious. If we want to encourage job creation, why do we provide disincentives? Taking people on low incomes out of taxation would reduce the burden on the state, not increase it.</li>

A graduated tax system is the fairest for society. It is ridiculous to tax low earners and end up with complex and costly systems for giving some of it back. The advantage of VAT and excise taxes which do affect us all equally is that they are capable of being avoided at the lower end (eg on fresh uncooked food) and it is a personal choice to spend on items that are heavily taxed, eg alcohol.There is an obvious exception here in fuel costs of course which are heavily taxed and often essential in rural and suburban locations, so the balance has to be drawn on reducing congestion and dealing with carbon issues here.</li>

<p>We can offer a sort of abstract well done for raising the PA, but since the problem at hand was the fact that 5m people were going to be worse off, and now 1m people will still be worse off, we’re entitled to point out that this probably wasn’t the correct solution, even if that is a little churlish.</p>
<p>I’m with Peter/James/Tim on low earning taxes (and I do recommend that anyone interested takes a look at LITRG’s website; they’re a great organisation, and we might do well to try and forge a few links with them as a party if they’d have us) but I’m also interested in Asquith’s link between not paying income tax and statist dependency. So does this mean you’d be against the idea of a Citizen’s Basic Income, for example?</li>

<p>This assumes that the main factor in determining success in life is the amount of help one has received from the state. I’m willing to go along with a variant of that argument as it relates to land values but I’m not at all sure that it extends to the value of labour. Yes, a good education makes a huge difference, but we already charge people for access to university. Do we not, <em>at some point</em>, have to recognise that what people do with their talents is down to their own choices and that those who succeed do so because they actually <em>deserve</em> it?</p>
<p>That’s not to say that there is no justification for higher taxes on higher earners, but the ‘we made you into a success so we want a cut of your earnings’ argument is a particularly bad one, in my opinion.</li>

<p>Perhaps it is a little idealistic to suggest that all low earners should be taken out of the tax system altogether, but we must surely do all we can to close the ever increasing gap between low and middle income earners.</li>

<p>It’s also a live issue in US politics; I recently read (can’t find the link unfortunately) that Republican strategists are worried that the lower-middle-class now pay so little in income tax that they see no benefit in the idea of tax cuts - the rich now contribute such a huge percentage of the funds for government spending that only they are so concerned about the levels of spending to want to restrain them in any way.</li>
